Your Rights as a Legal Guardian

 Legal guardianship refers to a legal relationship established by a court where an individual (the guardian) is given the authority and responsibility to care for another person (the ward), who is typically a minor or an adult who is unable to care for themselves due to incapacity or disability. 


My role, as your lawyer, is to ensure that the child/person in question receives the care and protection they need and to provide essential legal expertise and support to guardians, helping them navigate the complexities of guardianship law. 

 

Guardianship of a Minor:

  • This is established when a child’s parents are unable or unwilling to care for them. The guardian assumes the parental role, providing for the child's daily needs, education, and welfare.
  • Temporary Guardianship: This is a short-term arrangement, often used in emergency situations or when the parents are temporarily unable to care for the child.
  • Permanent Guardianship: This is a long-term arrangement, usually lasting until the child turns 18 or until the court decides the guardianship is no longer needed.


A guardian's responsibilities can vary but generally include:

  • Providing for Basic Needs: Ensuring the ward has adequate food, clothing, shelter, and medical care.
  • Education and Development: Making decisions about the ward's education, extracurricular activities, and overall development.
  • Financial Management: Handling the ward's finances, including managing any income, benefits, or assets.
  • Medical Decisions: Making healthcare decisions, including consenting to medical treatments and managing medical records.
  • Legal Representation: Representing the ward in legal matters and ensuring their rights are protected.
